TERMS AND CONDITIONS
Commencement:
By booking a lesson through the Site the Client agrees to these terms and conditions. The Client accepts that Peppo reserves the right to amend the terms and conditions at any time, effective immediately upon posting them on the Site.
Booking:
Clients who are registered with Peppo may book lessons on the Site. A lesson is booked when a lesson time slot has been confirmed as booked by Peppo. A booking creates an agreement between the Tutor to provide an on-line lesson at the time and date stated, unless it is cancelled as provided below and subject to the other terms and conditions.
Cancellation:
A booking may be cancelled on the Site, terminating the agreement to provide a lesson made between Client and Tutor. Cancellation by phone or other means may not be effective as Peppo may not be aware of such cancellation.
Both the Client and the Tutor may cancel a booking as follows:
Client cancellation: A Client may cancel a booking on the Site at any time before the lesson starts. Cancellations by a Client on the Site more than 24 hours in advance of the start of the lesson will receive a full refund however cancellations within 24 hours will not be refunded.
Tutor cancellation: The Tutor may cancel a lesson on the Site at any time before the lesson starts and, where practicable, give reasons to the Client. If the Tutor cancels the lesson the Client will receive a full refund for the lesson.
Payment terms:
The hourly fee shall be as stated on the Site. All payments shall be made to Peppo and not directly to the Tutor. Peppo will send an invoice for pre–payment for tutoring sessions requested by the Client. All payments for tutoring are due before tutoring services commence. Unless otherwise agreed with Peppo, if payment is not made 24 hours before the lesson starts then the lesson shall be deemed to have been cancelled and the Client shall remain liable to pay for the lesson.
Non-Payment:
Non-payment of sums due may, at Peppo’s option, result in the termination of this agreement. A returned payment or cancellation of a direct debit, standing order or other agreed payment method may result in the Client’s service being terminated without notice. Non-payment will also reduce the ability of Peppo to subsidise tutoring services to disadvantaged or seriously ill children or young people.
Client responsibilities:
In relation to the tutoring services the Client is responsible for:
maintaining the security of their username, password and identification and accepts responsibility for all activities that are carried out on the Site under their username, password or with their identification;
ensuring that the booking has sufficient detail for the Tutor to be able to prepare for the lesson accepting that the Tutor is engaged to educate and not to complete work on behalf of the Student;
ensuring that the Student attends the lesson on time and that the Client (or another responsible adult) is present where the lesson is taking place;
treating and procuring that the Student treats the Tutor with respect and fairness and does not subject the Tutor to abusive behaviour or language or make any inappropriate suggestions and does not contact the Tutor outside of the lesson whether by phone, social media or otherwise; and
ensuring that all technological equipment is in working order and available for use during the lesson (such equipment being a computer or iPad, recommended browser, webcam, a broadband internet connection with sufficient bandwidth, a sound card and a headset and microphone).
Peppo Responsibilities:
Peppo is an agency which procures and arranges tutoring services for Clients with such services being provided by Tutors. Peppo is only responsible for providing the Site, nominating a Tutor for the Student and for verifying the identity of the Tutor by carrying out a standard DBS check and obtaining references on the Tutor. Peppo takes no responsibility for the actions, conduct or teaching of the Tutors or their suitability for the Student. Neither Peppo nor any Tutor can guarantee any grade in an exam or any level of academic success.
Peppo is a community interest company and has not been established or conducted for private gain. Any profit generated from tutoring the Student will be used to subsidise tuition for disadvantaged or seriously ill children or young people.
Technology:
The Client agrees that lessons may be recorded and such recordings stored and used by Peppo. The Client accepts that from time to time the Student may experience entire or partial technological difficulties during a lesson including a failure of video during due to fluctuations or insufficient bandwidth. Under such circumstances the lesson shall continue without video by phone and there will be no full or partial refund for technological malfunction or bandwidth related interferences.
Client Warranties:
The Client warrants, represent and undertake that he/she:
is 18 years of age or older and has the capacity to agree to this agreement;
has provided accurate, current and complete information on the Site about themselves and the Student;
will comply with all the Client’s responsibilities and obligations set out in this agreement;
will in no way try to undercut or transact independently with a Tutor thereby disintermediating Peppo (such behaviour will result in the Client being required to pay fees and expenses on all independent bookings and will result in an underprivileged child receiving less or no tuition);
has read and understands Peppo’s Safeguarding Policies, Safeguarding Procedures and Conduct of Behaviour guidelines which can be accessed on the Site; and
agrees to comply with all applicable laws, regulations and codes of practice which regulate the activities of the online environment and data protection.
The Client agrees to indemnify and hold harmless Peppo (and any Tutor as the case may be) on demand, and shall keep Peppo (and any Tutor) fully and effectively indemnified against any and all losses arising out of or in connection with any breach of this agreement by the Client and any and all claims, complaints or legal proceedings instigated by a Tutor against Peppo in relation to the activities of the Client or related Student.
Termination:
This agreement may be terminated by the Client by giving 30 days’ notice in writing to Peppo of such termination provided that such termination does not occur during the first 4 hours of tutoring. If the agreement is terminated by Client prior to completion of the first 4 hours of tutoring, the Client shall be responsible for payment for the first 4 hours of tutoring.
This agreement may be cancelled by Peppo by giving 30 days’ written notice to the Client and without provision of any tutoring services for that period. Peppo shall refund any unused balance that may have been paid in advance by the Client.
Governing Law and Jurisdiction:
These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales. Peppo and the Client agree that the courts of England and Wales are to have exclusive jurisdiction to settle any dispute which may arise out of or in connection with these terms and conditions.
Defined terms:
In these terms and conditions:
“Client” means the person who, through the Site has requested tutoring services for a Student;
“Peppo” means Peppo Tutors CIC;
“Site” means the website on the domain www.peppo.org; and
“Student” means a child or young person under the age of 18 who will receive the tutoring services;
